We also have noticed that widespread attention from the international society has been drawn to the issues relating to the conservation and sustainable use of Marine Biological Diversity Beyond Areas of National Jurisdiction (BBNJ).The General Assembly has established an Ad Hoc Open-ended Informal Working
Group to discuss relevant issues.The scope covered by the working group rs rather broad, which includes the conservation and sustainable use of BBNJ, the sharing of benefits from the utilization of marine genetic resources, area based management tools for BBNJ, environmental impact assessments, and capacity-building and transfer of marine technology from the exploitation of marinegenetic resources, etc.The core concern of every country lies in the legal status of BBNJ and whether we should design new international rules specially for theconservation and sustainable use of BBNJ.In a meeting of the Ad Hoc Informal Working Group convened in 2013, countries had a unanimous agreement on the proposal of setting up a new agenda to discuss the submitted suggestions andopinions in relation to the scope, parameter and feasibility of the new rules.On that basis, the Working Group will submit a recommendation to the General Assembly before 2015.
The conservation and sustainable use of BBNJ is a newly emerged issue which has a close relation to the regime of the outer continental shelf and the Area.For example, there are significant disagreements on the legal status of marine genetic resources, where some countries hold that the principle of common heritage of mankind applies in determining the legal status of marine genetic resources, while others, in comparison, stand for the regime of high seas, or call for a new regime.Deliberations on these proposals necessarily involve a careful examination on certain aspects, such as the current responsibility and competent of the Authority, and the rights and obligation of coastal States over the marine genetic resources on its outer continental shelf, etc.
